TERMS AND CONDITIONS FOR THE USE OF  CITIZENSEYE  

These Terms and Conditions of Use ("Terms") govern your use of the CitizensEye Android mobile application ("App") provided by CitizensEye ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree with these Terms, do not use the App.

1. License and Use

1.1 License: We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on an Android device owned or controlled by you, in accordance with these Terms.

1.2 Restrictions: You may not:

(a) modify, adapt, translate, or create derivative works of the App;
(b) reverse engineer, decompile, disassemble, or attempt to extract the source code of the App;
(c) distribute, sublicense, lease, rent, loan, or otherwise transfer the App to any third party;
(d) remove, alter, or obscure any copyright, trademark, or other proprietary notices from the App; or
(e) use the App in any unlawful manner or for any unlawful purpose.

2. Privacy

2.1 Privacy Policy: Your use of the App is subject to our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

3. User Content

3.1 Submission of Content: You may submit content, including text, photos, and videos ("User Content"), through the App. By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in connection with the App and our business.

3.2 Responsibility for Content: You are solely responsible for the User Content you submit through the App. You represent and warrant that you have all necessary rights to submit the User Content and that the User Content does not violate any third-party rights or applicable laws.

4. Intellectual Property

4.1 Ownership: The App and all intellectual property rights therein are and shall remain our exclusive property or the property of our licensors. Nothing in these Terms grants you any right, title, or interest in or to the App or any intellectual property rights therein.

5. Termination

5.1 Termination: We may terminate your access to the App at any time, with or without cause, and without notice to you. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

6. Disclaimer of Warranties

6.1 No Warranties: THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

7.1 Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF YOUR ACCESS TO OR USE OF THE APP.

8. Governing Law and Dispute Resolution

8.1 Governing Law: These Terms and any disputes arising out of or related to these Terms or the App shall be governed by and construed in accordance with the laws of Indian Courts.

8.2 Dispute Resolution: Any dispute arising out of or relating to these Terms or the App shall be resolved exclusively by arbitration administered by Indian Council of Arbitration in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Hyderabad, Telangana, INDIA, and the language of the arbitration shall be English.

9. Changes to Terms

9.1 Changes to Terms: We reserve the right to modify or amend these Terms at any time, in our sole discretion. We will notify you of any material changes to these Terms by posting the revised Terms within the App or by other reasonable means. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the revised Terms.
